Condos and townhomes

Rule 1403 says outright that condominiums, townhouses and apartments are not single-unit dwellings. That removes both the owner-occupant exemption and the under-100-square-foot survey exemption, so even a small condo remodel starts with a survey. Shared walls, attics and HOA approval also shape when and how the work area is sealed.

Fire- and water-damaged structures

A building destroyed by fire, explosion or natural disaster, including its debris, remains subject to Rule 1403. South Coast AQMD's fire guidance asks owners who arrange their own cleanup to hire a certified consultant to survey, with the abatement contractor filing any notification. Flooded or burned materials crumble easily, so the area is kept closed until it has been sampled.

The written survey lists each material sampled, where it is, how much there is and the lab result, and it must be kept on site while the work is under way. Give a copy to your general contractor and to every trade that will cut or demolish. A remodeler who does not hold the CSLB asbestos classification or certification needed for the job has to subcontract the abatement, so ask who is actually doing the removal.
